Website terms
These Terms govern use of the L.I. Pools public website to the extent permitted by applicable law. L.I. Pools is a national U.S. brand; these Terms do not establish service availability in every location or identify one state’s law as controlling every transaction. Using the website or requesting service is not consent to promotional calls or texts.
Website information
Website information is general and may change. Appropriate recommendations depend on actual pool volume, chemistry, equipment, site conditions, inspection, manufacturer requirements and other property-specific circumstances. Website material is not itself a binding estimate, diagnosis, service agreement, warranty or confirmed appointment.
Service requests and written agreements
A Request Service submission is an inquiry. It does not confirm an appointment, guarantee coverage or availability, accept a job, establish final pricing, or itself create a final service contract. L.I. Pools may contact you to assess the request.
Estimates, proposals, work orders, invoices, checkout disclosures or service agreements may contain additional or different terms. Where legally appropriate, agreed transaction-specific written terms govern that transaction. They do not override consumer protections that cannot lawfully be waived.
Accurate information and customer responsibilities
Provide accurate contact, property, pool, equipment, access, hazard and relevant service-history information reasonably needed for the requested work. Tell us when you are uncertain; an estimate, typo, innocent measurement error or good-faith disagreement is not automatically fraud or a crime. You should be authorized to request work at the property and to provide another person’s information.
Fraud, scams and system abuse
You may not knowingly impersonate another person; provide fraudulent identity or payment information; intentionally submit materially false information for an unlawful or fraudulent purpose; obtain services by fraud; submit malicious requests or code; attempt unauthorized access; interfere with security; or use our systems or services for unlawful activity. Malicious automation, credential attacks and unlawful or unauthorized scraping are prohibited.
L.I. Pools may decline or terminate requests/interactions, pause services where lawful, preserve evidence, investigate suspected misuse, dispute fraudulent transactions or payment disputes, cooperate with processors, financial institutions and appropriate federal, state or local law-enforcement or regulatory authorities, and pursue available civil remedies or other lawful rights. This does not restrict good-faith billing disputes, lawful chargebacks, consumer complaints or statutory protections. We do not promise criminal prosecution or claim that L.I. Pools prosecutes crimes.
Property access and site conditions
For scheduled service, provide authorized and reasonably safe access and disclose known hazards. Unknown, unsafe or materially different site conditions may affect scope, scheduling, pricing or the ability to work. We may decline or pause work presenting an unreasonable safety, legal or property risk. Necessary scope or price changes should be addressed in the applicable agreement and approved where required; these Terms do not authorize arbitrary extra charges.
Payments
Payment timing, any deposit, price and other financial terms are governed by the applicable estimate, proposal, invoice, service agreement, checkout disclosure or other transaction-specific terms. No deposit percentage or payment schedule is created by this website. The public Request Service form does not collect payment credentials or authorize a charge.
Cancellations, rescheduling and service refunds
L.I. Pools may reserve service time, dispatch personnel, purchase chemicals/materials, order equipment or custom products, and incur costs for a particular property. Payments associated with completed services and documented nonrecoverable job-specific expenses are generally non-refundable, except as required by applicable law or expressly agreed otherwise in writing. This is not a blanket no-refunds policy.
Depending on the transaction and applicable law, such costs may include completed labor/services; chemicals purchased for the job and no longer recoverable or already used; installed materials; opened/used items that cannot reasonably be returned; special-order equipment; custom products, liners or safety covers; actual manufacturer restocking/nonreturnable costs; permits, inspections and third-party charges; and other documented nonrecoverable expenses. Recoverable or unused amounts are not automatically forfeited merely because work was scheduled.
Job-specific cancellation, rescheduling, deposit, refund and restocking terms should be disclosed in the applicable agreement. Contact us promptly if plans change or you question a charge. We will consider the agreed terms, work performed, documented costs and applicable law. Nothing here eliminates statutory cancellation, refund, warranty or other rights that cannot lawfully be waived.
Separately sold products and returns
For separately sold physical products, return eligibility depends on the transaction-specific policy, condition, disclosed manufacturer/vendor rules and applicable law. No general return entitlement or universal final-sale rule is created here. Merchandise returns and refunds for services are distinct; neither classification defeats non-waivable rights.
Premier and future recurring services
Premier Pool Care scope and frequency are determined by the applicable service agreement. These website Terms do not enroll you in recurring billing or authorize automatic charges. Any later recurring program requires transaction-specific disclosures, including amount, frequency, renewal terms, cancellation procedure and affirmative authorization where required before enrollment. No recurring-billing functionality is activated by this policy.
Third-party products
Some products or equipment are manufactured, supplied or warranted by third parties and may have manufacturer terms or warranties. Those terms do not eliminate L.I. Pools obligations or customer rights that cannot lawfully be excluded. Contact our team to discuss the terms relevant to your purchase or service.
Communications and choices
By submitting a service request, you authorize reasonably necessary telephone, text or email contact to respond to and administer it, taking account of your preferred method. Promotional calls/texts require a separate optional choice; declining it does not prevent a service inquiry or purchase. The checkbox does not enroll you in marketing email.
Withdraw promotional consent, request no promotional calls, or ask about preferences at sales@li-pools.com or 833-LIPOOL5 (833-547-6655). Reply STOP where a texting system supports replies; this website has no automated STOP processor. Use a marketing email’s unsubscribe mechanism when offered or contact us directly. We must honor applicable opt-out and suppression obligations before future promotional contact.
A marketing opt-out does not necessarily prevent reasonably necessary communications about an active request, service, transaction or legal notice, subject to applicable consent/revocation rules. Withdrawal does not make previously lawful communications unlawful. The Privacy Policy provides more information about personal information and privacy requests.
Availability and third-party links
We cannot guarantee uninterrupted or error-free website availability. We may maintain, correct or temporarily suspend website functions. Links to third-party sites, where present, do not mean we control their content, security or policies; review their terms before using them.
Intellectual property
The L.I. Pools name, logo, site design, original text, graphics, and owned or licensed photographs and other protectable materials belong to their respective owners. You may use the site to learn about and request services. Unauthorized reproduction or exploitation is prohibited to the extent permitted by applicable law, subject to lawful exceptions and third-party rights.
Qualified disclaimers
To the fullest extent permitted by applicable law, general website information is provided without a promise that it is complete, error-free or suited to every property. No general disclaimer displaces an express written commitment, applicable implied warranty, non-waivable consumer protection or legally required security/incident-response duty. Reasonable safeguards do not guarantee absolute cybersecurity.
Limits subject to applicable law
To the fullest extent permitted by applicable law, L.I. Pools is not responsible for remote or unforeseeable consequential loss arising solely from reliance on general website information. Any enforceable transaction-specific limitation must be assessed under its written terms and applicable law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, statutory violations or any other liability that cannot lawfully be excluded or limited. These Terms do not waive all claims for data breaches, identity theft or negligence and do not remove mandatory remedies. We impose no blanket damages cap or mandatory arbitration through this page.
Applicable law and jurisdiction
The applicable law and appropriate jurisdiction may depend on the contracting L.I. Pools entity, service/property location, customer location, transaction, written agreement and mandatory federal, state and local law. These Terms do not require all U.S. customers to waive their state protections or accept a universal New York forum. Any future forum-selection or dispute-resolution provision requires separate review and appropriate agreement.
Severability
If a provision is found invalid or unenforceable, it will be limited or severed to the extent permitted by applicable law without invalidating the remaining lawful provisions. This does not authorize rewriting an agreement to remove mandatory consumer protections.
Changes to website terms
We may update these website Terms prospectively and update the Last Updated date for material changes. Posting new terms does not retroactively alter an executed service contract where prohibited or create consent that requires a separate affirmative act. Additional notice or agreement will be obtained where required.
